Too few convictions... too many in jail?

Two stories both appearing on BBC News online today. I agree with one and not the other.

Convictions too few - Goldsmith
Conviction rates for serious offences such as wounding and rape are too low, the Attorney General has admitted.

Lord Goldsmith said victims had a right to be worried but the government was working to tackle the problem and more offenders were being taken to court

Too many in jail, says top judge
Far too many people are being imprisoned in England and Wales, the country's top judge has warned. Lord Chief Justice Lord Phillips told the Guardian that offenders should be rehabilitated in the community, and be sent to jail only as a last resort.
